Terms of Service

By accessing or using Syft ("Service"), operated by [your legal entity name] ("Syft," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These Terms apply to all users of syfted.app and any related Syft applications.

You must be at least 18 years old to use Syft. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into these Terms. Syft is not intended for use by minors. If we learn that a user is under 18, we will terminate their account.

When you create an account, you are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately if you suspect unauthorized access to your account at hello@syfted.app.

You may not create an account on behalf of another person without their authorization. You are responsible for all activity that occurs under your account.

Syft provides:

• AI-powered color season analysis from an uploaded photo
• A personalized fashion recommendation feed matched to your color palette
• Style profile tools including a style quiz, saved items, and color palette reference

Syft's recommendations are generated by an automated algorithm. They are intended as style inspiration, not professional styling advice. Product availability, pricing, and quality are determined solely by the third-party retailer, not by Syft.

When you upload a photo for color analysis, you grant Syft a limited, non-exclusive license to process that image for the purpose of generating your color season result. We transmit your photo to a third-party AI vision API (Google Cloud Vision) solely for this purpose.

You retain full ownership of any photos you upload. We will not use your photos for advertising, training AI models (beyond the immediate analysis session), or any purpose other than the features you explicitly use.

By uploading a photo, you represent that you have the right to do so — either because it is an image of yourself or you have appropriate permission from the subject.

Syft participates in affiliate marketing programs. This means that when you click on a product link in the Syft feed and make a purchase, Syft may earn a commission from the retailer. This commission is paid by the retailer — you pay nothing extra.

Affiliate relationships do not influence which products appear in your feed. Recommendations are determined solely by your color season, style preferences, and behavioral signals (saves and clicks). We do not accept payment from brands to feature their products in your personalized feed.

The Syft feed contains links to products sold by third-party retailers. Syft is not responsible for:

• Product quality, accuracy of product descriptions, or availability
• Pricing, which may change after a product appears in your feed
• Any transactions you make with third-party retailers
• The privacy practices of third-party retailer websites

When you leave Syft and visit a third-party site, that site's own terms and privacy policy govern your interaction.

You agree not to:

• Scrape, copy, or systematically download Syft's product catalog or recommendation data
• Attempt to reverse-engineer, decompile, or extract Syft's algorithms or models
• Create accounts using false identities or on behalf of others without authorization
• Use Syft in any way that violates applicable laws or regulations
• Upload content that is unlawful, harmful, or that you do not have the right to share
• Interfere with the security, integrity, or performance of the Service

Syft and its content — including the color analysis algorithm, recommendation engine, brand identity, design, and editorial content — are owned by [your legal entity name] and protected by copyright, trade secret, and other intellectual property laws.

You are granted a limited, personal, non-transferable license to use the Service for your own non-commercial, personal use. You may not reproduce, distribute, or create derivative works from Syft's content without written permission.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SYFT DOES NOT WARRANT THAT:

• The color season analysis will be accurate for every user
• Product recommendations will result in purchases you are satisfied with
• The Service will be uninterrupted, error-free, or free of harmful components
• Any particular product will be available at the price shown

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SYFT AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR DISSATISFACTION WITH PRODUCTS PURCHASED THROUGH AFFILIATE LINKS.

IN NO EVENT SHALL SYFT'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) $50 USD OR (B) THE AMOUNT YOU PAID TO SYFT IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold Syft harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

You may delete your account at any time from your profile settings or by emailing hello@syfted.app.

We may suspend or terminate your account if we believe you have violated these Terms, without prior notice for serious violations. Upon termination, your right to use the Service ceases immediately. Sections 9–12 of these Terms survive termination.

These Terms are governed by the laws of the State of [your state], United States, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the courts of [your state].

Before initiating any legal action, you agree to first contact Syft at hello@syfted.app and attempt to resolve the dispute informally for at least 30 days.

For any dispute that cannot be resolved informally, you and Syft agree to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive the right to participate in a class action lawsuit against Syft.

We may update these Terms from time to time. We will post the revised Terms with an updated date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. For material changes, we will provide 14 days' notice by email to registered users.
